Information on personal data processing for contacts to whom VM.PL Sp. z o.o. directs its marketing activities.

Dear Sir or Madam,

we would like to inform you that VM.PL Sp. z o.o. with its registered office in Wrocław (ul. T. Kościuszki 82, 50-441 Wrocław, Poland) processes information from various public sources (including the Internet and social media) and on this basis creates databases. This information may include personal data within the meaning of Regulation 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter "Regulation" or "GDPR").

In accordance with the applicable data protection provisions, including the Regulation, the person which data is processed should receive information about processing of personal data in accordance with Article 13 or 14 GDPR, depending on whether it comes directly from the data subject or from other sources.

Therefore, we would like to inform you as follows:

1. The controller of your personal data processed in connection with sending marketing information is VM.PL Sp. z o.o., with its registered office in Wrocław, ul. T. Kościuszki 82, 50-441 Wrocław, registered by the District Court for Wrocław-Fabryczna, 6th Economic Division of National Court Register under KRS number 0000201477, tax identification number 8951811558, REGON number: 932985224, share capital 116,400.- PLN, hereinafter ”VM.PL” or “controller”.
Please direct any questions or doubts in regards to processing your personal data, as well as notifications of requests to exercise data subjects rights, to VM.PL in writing by post at the following address: VM.PL Sp. z o.o., ul. 2. Your personal data (name, e-mail, other contact details, data on your company or organization, including its location, your position, other data from you social media accounts, e.g. LinkedIn, your communication with VM.PL) will be processed on the basis of Article 6(1)(f) of the GDPR, i.e. for direct marketing and statistical purposes on the basis of the legitimate interests of the controller. Legitimate interests of VM.PL consist in providing customers or potential customers with information on software development services, other services or products to satisfy their needs. The data processing for the above-mentioned purposes of services is carried out within the scope of VM.PL's business activity, as indicated in the Register of Entrepreneurs of the Polish National Court Register. It is necessary for VM.PL to be able to inform customers or potential customers about its services.
In exceptional circumstances your data may also be processed for the exercise/defense of legal claims (Article 6 (1) (f) of the GDPR) as a legitimate interest of VM.PL as the data controller.

3. VM.PL does not process any special categories of personal data or personal data relating to criminal convictions and offences.

4. The controller obtained you personal data from publicly available sources, e.g. public registers, websites, business and employment-focused social media, including LinkedIn, Xing, etc. While obtaining and processing your personal data the controller applies the principle of data minimization referred to in Article 5(1)(c) of the GDPR.

5. Your personal data can be provided to processors rendering services supporting the day-to-day activity of VM.PL, such as providers of IT and marketing services and tools. Due to the fact that VM.PL uses selected tools which may transfer personal data among others to the USA, i.e. outside the European Economic Area (EEA), we take care that the transfer of such data is always carried out with appropriate safeguards, such as e.g. standard data protection clauses (in accordance with Article 46 (2) GDPR). 6. Your personal data are stored for a period of up to 3 years or less (e.g. if your contact data is no longer active), or until the right to object will be exercised. When justified your personal data can be stored until the expiry of the limitation period.

7. To the extent under applicable law you have the right to: (1) request access to personal data, (2) rectification of the data, (3) deletion, (4) restriction of processing, (5) the right to object to processing and (6) the right to data portability. However, we inform that any requests made regarding the above stated rights shall be evaluated in the light of GDPR regulations and therefore we do not guarantee their exercise in every case.
You also have the right to lodge a complaint to the supervisory authority (in Poland: the President of the Personal Data Protection Office).

As a data controller, VM.PL takes care to ensure adequate data security measures in accordance with applicable regulations and the information and data protection security policies adopted by VM.PL by applying appropriate technical and organizational security measures to protect personal data from accidental or intentional destruction, loss, alteration, unauthorized use or disclosure.

We use tools from various companies to collect your data, always ensuring the necessary level of security and confidentiality. Our website https://vm.pl uses cookies. These are small text files sent by the web server to the user's browser and stored by this software. When the browser reconnects with the site, the website recognises the type of device the user connects with. The parameters allow to read information contained in them only by the server that created them. Therefore, cookies make it easier to use previously visited websites.

The information collected relates to the IP address, type of the browser used, language, type of the operating system, Internet service provider, information about time and date, location and information sent to the website via the contact form.

The collected data is used to monitor and check how the users use our websites, and to improve the functioning of the website, ensuring more effective and seamless navigation. User information is monitored with the use of the tools described below.

We use cookies to guarantee the highest standard of convenience of our website, and the collected data is used only inside our company VM.PL Sp. z o. o. for marketing and sales purposes as well as for optimising these activities.

Additional personal data, such as an e-mail address, is collected only in places where the consent is expressly given by completing the form by the user. The above data is kept and used only when necessary to perform the given function.

Currently, the following plugins are used on the entire VM.PL website to collect and process your data based on cookies:

  • Google Analytics (Google Tag Manager)
  • Facebook Pixel
  • Hotjar

Use of Google Analytics

Google Analytics serves to analyse the use of the website. The data obtained is used to optimise our website and advertisements.

Google Analytics is a web analysis service operated and provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google processes data on the use of the website on our behalf and undertakes contractually to take actions to ensure confidentiality of the data processed.

When visiting the website, the following information will be recorded:

  • Names of sites visited
  • Your actions on sites (e.g. clicks, scrolling and duration of stay)
  • Your approximate location (country and city)
  • Your IP address (in short form so that a unique assignment is not possible)
  • Technical information such as a browser, the Internet provider, terminal and screen resolution
  • Source of your visit (i.e. via which website or advertising materials the user visited our site)
  • The above data is sent to the Google server in the USA. Google complies with the data protection provisions concluded in the EU-US privacy agreement.

Google Analytics stores cookies in a web browser for a period of two years starting from the date of your last visit. Cookies contain a randomly generated user ID that will allow to recognise the user during future visits to the site.

Your recorded data is stored together with the randomly generated user ID that allows for evaluation of anonymous user profiles. Such user data is automatically deleted after 14 months. Other data remains stored in an aggregated form for an indefinite period.

If you do not agree to the collection and processing of your data described above, you can prevent this by one-off installation of the browser add-on to disable Google Analytics.

Use of Facebook Pixel

We install a user behaviour monitoring pixel on our website, provided by

Facebook Inc. 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”)

When you visit our site, your data is collected by us by means of cookies provided by Facebook. This data is then sent to Facebook. Users' behaviour can be monitored when they are redirected to the advertiser's site after clicking on an advertisement on Facebook. This type of monitoring is performed for statistical and market research purposes. It also helps in optimising further advertising activities.

The stored data is anonymous, it does not provide any information on the identity of users. However, it is collected and processed by Facebook, therefore it is possible to connect it to the respective user profile, and Facebook can use this information for its own advertising purposes, in accordance with the rules of using Facebook data:https://www.facebook.com/about/privacy/. You can change the display settings of Facebook advertisements and its partner sites. Separate cookies may be stored on your computer for these purposes.

Only users who are at least 13 years of age may agree to use the user behaviour monitoring pixel.

Use of Hotjar

Hotjar is a tool used to analyse and visually represent user behaviour on the Internet. We use the so-called heat maps, Hotjar surveys to improve the comfort of using our website. Hotjar collects real-time responses from any device. The data is stored in Ireland for 365 days starting from the date of the data capture.
