Terms of Service for VM.PL AI Chat

INTRODUCTION

  1. The Terms and Conditions define the rules for VM.PL Sp. z o.o. (“VM.PL”) providing an electronic service that includes the possibility for the User to engage in an interactive real-time chat conversation with a tool that automatically generates content using artificial intelligence on topics related to VM.PL (“Service”).
  2. Using the Service requires acceptance of these Terms and Conditions, which occurs by confirming the Terms or by using the Service.

Terms of Service Use

  1. To use the Service, it is necessary to have:
  1. a device with Internet access (laptop, computer, smartphone, etc.),
  2. a web browser (e.g., Chrome version 134.0 or higher, Firefox version 137.0 or higher),
  3. Internet access.
  1. Users of the Service may only be natural persons using the Service.
  2. The Service is provided free of charge.
  3. The Service allows obtaining answers to several questions about VM.PL, and then redirects the User to send an email message with further inquiries.
  4. Content generated by the Service does not constitute an offer directed to potential clients within the meaning of Article 543 of the Civil Code.

Content Obtained While Using the Service

  1. The provision of the Service begins when the User initiates a chat conversation. The User may terminate the Service at any time by exiting the chat.
  2. Users are prohibited from providing unlawful content (e.g., copyrighted material belonging to others) or content that violates social norms (e.g., vulgar or erotic content). The User is responsible for the content submitted to the Service.
  3. In justified cases, VM.PL reserves the right to block access to the Service for Users who do not comply with the Terms and Conditions.
  4. Since the content in the Service is generated by artificial intelligence, VM.PL does not guarantee the outcomes provided by the Service. We recommend verifying any obtained information, for example, by contacting VM.PL. VM.PL is not liable for actions taken by the User based on the information obtained from the Service.
  5. The Service does not provide a history of past conversations or access to them.
  6. VM.PL makes no warranties regarding the accuracy, truthfulness, completeness, or usefulness of the information obtained through the Service.

Personal Data of Users

  1. In connection with using the Service, we process personal data provided by the User. This may include an email address and other data such as first and last name, or the company the User works for.
  2. The administrator of Users’ personal data processed in connection with the Service is VM.PL Sp. z o.o., ul.   4. The personal data of the User mentioned above and provided in the chat will be processed by VM.PL to respond to the User’s questions and to perform services as specified in the Terms. The legal basis for processing is VM.PL’s legitimate interest in providing information about the company, under Article 6(1)(f) GDPR. Providing personal data is voluntary to use the Service. Providing an email address is necessary for VM.PL to contact the User and provide further information about the company or its services. Failure to provide an email address will result in no contact from VM.PL.
  5. If the User provides an email address in the chat, they may receive commercial or marketing information from VM.PL, such as information about VM.PL products, services, events, or language courses. The legal basis for sending such information is consent by providing the email address (legal basis: Article 398 of the Act of 12 July 2024 – Electronic Communications Law) and VM.PL’s legitimate interest in direct marketing (legal basis: Article 6(1)(f) GDPR). Providing an email address and consenting is voluntary but necessary to receive commercial and marketing information from VM.PL via email. Failure to provide data or consent will result in inability to send such information.
  6. In justified cases, Users’ personal data may also be processed for the purposes of pursuing or defending claims, as a legitimate interest of VM.PL under Article 6(1)(f) GDPR.
  7. We may disclose User data to entities cooperating with us in providing the Service, e.g., our IT solution providers.
  8. Users’ personal data will be retained as long as necessary for the processing purposes described above, however not longer than until the statute of limitations expires or consent is withdrawn.

Personal data of Users who consent to receive VM.PL commercial or marketing information via email may be transferred outside the EEA, including to the USA, due to VM.PL’s use of certain marketing tools.   2. In case of personal data breach, Users have the right to lodge a complaint to the supervisory authority (President of the Personal Data Protection Office).

Complaints

  1. Complaints regarding the Service may be submitted by Users via email to reklamacje@vm.pl or in writing to the address of VM.PL’s registered office within 14 days of ending the use of the Service. The deadline is met if VM.PL receives the complaint on time.
  2. When submitting a complaint, the User should describe the subject of the complaint clearly and concisely.
  3. Properly submitted complaints will be reviewed by VM.PL immediately, but no later than 14 days from receipt. The complainant will be notified of the outcome via email or regular mail (depending on submission method) within 7 days after the decision is made.
  4. If the complaint procedure is exhausted and VM.PL does not uphold the complaint, the User has the right to bring the matter before a common court.
  5. Consumers also have the right to use out-of-court dispute resolution and claims mechanisms, including referral to a permanent consumer arbitration court at the Trade Inspection, the provincial inspector of the Trade Inspection, or the district (municipal) consumer ombudsman or a consumer protection organization.

Final Provisions

  1. VM.PL reserves the right to change the provisions of these Terms. The amended Terms shall apply from the date the amended version is published on the VM.PL website.
  2. Commencement of use of the Service means that the User has read these Terms and accepts their contents. By using the Service, the User consents to the Terms and agrees to comply with them.
